la precedente lettera aperta del 15 febbraio 2011, trasmessa da questa Unione sindacale all'indirizzo del segretario generale giuliani@fids.it , con la quale si richiedevano, nell'interesse primario dello sport e del CONI, interventi immediati e risolutivi nel segno del cambiamento;
PRESO ATTO
che i principi comportamentali delle giurie e votazioni, disposti dal Commissario in data 18 febbraio 2011, vengono disattesi senza che nessuno prenda provvedimenti, lasciando intendere che sia lecito giudicare i propri allievi e quelli del proprio team, non solo e non tanto nelle gare autorizzate dalla FIDS ed organizzate dalle ASA, come nel caso del 5. TROFEO NEW EUROPE DANCE CORNAREDO, 6. TROFEO LOMBARDIA DANCING CASTELLANZA, FANTASTIC DANCE OPEN DI CORNAREDO, ma anche e soprattutto nelle competizioni di coppa Italia e dei campionati regionali come nei seguenti casi, accertati attraverso lo spulcio degli skating e che si riportano solo a titolo di esempio:
1)COPPA ITALIA BIELLA 20 febbraio 2011
2)Campionato Regionale Piemonte (BIELLA) 6 marzo 2011 ;
RITIENE,
che la mancanza di controlli e conseguentemente di provvedimenti sanzionatori, abbia innescato un meccanismo distorto che allontana inevitabilmente il trasgressore dall'adottare comportamenti conformi a tali principi, inducendolo a reiterare la violazione nella consapevolezza che tanto, dopo lo svolgimento della gara e l'omologazione dei risultati, nessuno interverrà;
RITIENE,
che tali principi comportamentali, di per se insufficienti e di scarso impatto con la dura realtà, abbisognano di integrazioni e modificazioni per poter conseguire lo scopo per il quale sono stati emanati, altrimenti la ratio di essi verrebbe vanificata con la conseguenza che verrebbe meno, come in effetti si è verificato e continua a verificarsi in molte gare, la certezza di un corretto e leale svolgimento della competizione sportiva e la genuinità dei suoi risultati, che rappresentano il bene giuridico tutelato dal nostro ordinamento giuridico;
RITIENE,
altresì, che la designazione ad “libitum” degli ufficiali di gara, finora operata dalla FIDS in tutte le gare, in violazione dell'articolo 66 del proprio statuto , unitamente alla mancanza di un Ruolo ufficiale e pubblico di giudici di gara, distinto per disciplina ed anche per Regione, , dal quale attingere, siano elementi di forte turbativa del sistema gare, capaci di generare e perpetuare ancora oggi,dopo il terremoto giudiziario che si è abbattuto sulla FIDS, l'illecito di cui al reato di frode in competizione sportiva previsto dall'articolo 1 della legge 401 del 1989;
RITIENE, inoltre, che la FIDS, ai diversi livelli di responsabilità, non possa continuare in tal modo a gestire gare, di qualsiasi livello, che le danno un enorme introito di denaro-come nel caso dei soli campionati regionali, il cui importo ha superato di gran lunga i 500000 euro-senza garantire a tutti gli atleti che partecipano il diritto riconosciuto dal nostro ordinamento giuridico che è quello della certezza che i giudici di gara siano designati secondo criteri di massima trasparenza in conformità alle norme statutarie, che nessuno dei componenti del collegio giudichi le proprie coppie o allievi di società sportive presso cui esercitano attività di insegnamento e che sia realmente attuata per ogni ballo la rotazione dei giudici e competitori attraverso un sistema che elimini ogni possibilità di combine;
RITIENE,
altresì, che la FIDS, essendo responsabile di tutte le gare che si svolgono sul territorio nazionale, ivi comprese quelle locali, denominate impropriamente private, ma che private non sono perchè autorizzate da essa e rientranti sotto l'egida del CONI, abbia l'obbligo giuridico di apprestare ogni mezzo e di assumere ogni iniziativa, ai diversi livelli di responsabilità, volta al perseguimento delle finalità di legge;
RITIENE,
pertanto, che la consapevolezza di ciò che si sta verificando nelle varie competizioni e la mancanza di idonei, tempestivi ed efficaci provvedimenti, siano elementi molto significativi, specie dopo l'ulteriore provvedimento commissariale del 1 aprile che continua ad essere disatteso, da indurre a credere che si stia innescando un meccanismo comportamentale distorto, che potrebbe essere interpretato come dilatorio ed omissivo, inconciliabile con la delibera dell'8 febbraio, pubblicata sul sito federale il 10 marzo 2011, con la quale il CONI ha commissariato la FIDS per gravi irregolarità nella gestione e gravi violazioni dell'ordinamento sportivo, nonché per mancata adozione di adempimenti statutari e/o regolamentari che hanno assunto evidente rilevanza sull'indispensabile necessaria garanzia di regolare svolgimento delle competizioni sportive nazionali;
RITIENE,
quindi, che, in questo particolare e delicato momento, sia necessario ed inderogabile da parte del Commissario, conformemente all'incarico ed ai poteri conferitigli con la precitata delibera 8 febbraio 2011 del CONI, porre in essere con immediatezza, senza più alcun indugio, disposizioni chiare, determinate ed efficaci volte a ripristinare il diritto dei competitori, reiteratamente leso, in modo da poterle applicare, in caso di recidiva, tassativamente e con rigore a tutti gli operatori del settore danza sportiva, senza distinzione alcuna di ruoli, compiti e funzioni;
CHIEDE,
pertanto, un incontro urgente, significando sin d'ora che, in mancanza di provvedimenti significativi e tempestivi volti a salvaguardare i diritti dei competitori, sarà costretta a richiedere nelle competenti sedi la sospensione di tutte le competizioni in calendario, nonchè quella del campionato italiano, con riserva di ogni altro diritto, azione o ragione.
